Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Markline, a scope-management SaaS provided by Roy Thande (t/a Markline) via markline.app (“Markline”, “we”, “us”). By creating an account or using the service you agree to these Terms.
1. The service
Markline is a subscription software service for agencies. It reviews client requests against a statement of work, flags likely out-of-scope work, and drafts change orders. Markline is a scope-management tool; you are responsible for how you use its output in your own commercial decisions.
2. Accounts
You sign in with a passwordless sign-in link. You are responsible for keeping access to your email account secure and for activity under your account. You must provide accurate information and be authorised to bind the organisation you represent.
3. Licence and acceptable use
We grant you a limited, non-exclusive, non-transferable right to use Markline for your internal business purposes during your subscription. You must not:
- resell, sublicense, or provide the service to third parties as a bureau;
- reverse engineer, scrape, or attempt to disrupt or bypass access controls;
- upload unlawful content or content you have no right to submit;
- use the service to build a competing product.
4. Payments, subscriptions, and reseller
The Markline Solo plan is US$49 per month, or US$490 per year, billed in advance and renewing automatically until cancelled. Localised pricing may apply in your region.
When you buy a Markline subscription, your order is processed by Paddle.com Market Ltd (“Paddle”), which acts as the Merchant of Record and authorised reseller. Paddle is the seller of record for your purchase: Paddle appears on your card or bank statement, issues your invoice and receipt, and collects and remits any applicable sales tax or VAT. Markline licenses and supports the software; Paddle handles billing and executes refunds. Your purchase is also subject to Paddle’s buyer terms at paddle.net.
You can cancel at any time from your account (which opens the Paddle customer portal) or through Paddle. Cancellation stops future renewals; see our Refund Policy for what happens at period end.
5. Disclaimer of warranties
The service is provided “as is” and “as available”. Markline makes no warranty that its scope assessments or drafted change orders are complete, accurate, or fit for a particular purpose. They are informational and do not constitute legal or professional advice.
6. Limitation of liability
To the maximum extent permitted by law, Markline is not liable for any indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the service is limited to the amount you paid for it in the twelve months before the claim.
7. Termination
You may stop using the service and cancel at any time. We may suspend or terminate access for breach of these Terms or where required by law. On termination your licence ends; sections that by their nature should survive (payment, disclaimers, liability) survive.
8. Governing law
These Terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute arising out of them — without affecting any mandatory consumer-protection rights you have where you live. Your purchase itself is made through Paddle.com Market Ltd (“Paddle”) as Merchant of Record and is additionally subject to Paddle’s own buyer terms.
